Department of Justice Investigate Wells Fargo Bank

Dear Justice Department Officials, Public Servants,

This letter comes requesting that the laws of the land protect individuals as well as corporations. It is time for the banks that have benefited from taxpayer dollars to be held accountable.

Wells Fargo Bank foreclosed on the property of XXXXXXX at XXXXXXWay in Antioch, CA, although she had been negotiating with the bank and had an offer in hand that had been accepted by Wells Fargo Bank for the sale of the property. While she had been negotiating with Wells Fargo Bank, bank officials went behind her back to foreclose on the property. There was no notice that foreclosure would take place on February 10. The foreclosure had been held off previously with an agreement to put the property up for sale. Previous offers for the home had been submitted to Wells Fargo.

Security Pacific Real Estate Company had a Wells Fargo accepted offer, yet the bank foreclosed. This is unfair and unjust. Now XXXXXXX with having foreclosure on her credit record that will make it harder for her to overcome the financial hardships she is experiencing. Wells Fargo Bank refused to rescind the foreclosure.

Something needs to be done to help the American people, who pay taxes, and who will have a hard time getting out of their financial situations because employers make decisions based on their credit ratings. The Fair Isaacs crediting rating system is not fair.

This situation is unconscionable. XXXXXXXXX, a hard working college educated Black American who has two jobs trying to achieve the American Dream for her family is a Viet Nam War Orphan. Her father Wyley Wright Jr., sacrificed his life for this country in Viet Nam, never holding his daughter, only seeing her photo. He died wen she was six months old, early in the war, to protect the business interests of this country and now she is betrayed by the country for which her family sacrificed. As Secretary of Defense Robert S. McNamara witnessed his death while on tour of Viet Nam it should have been a sign to him not to proliferate the war. The Shannon Wright base in Vinh Long, Viet Nam bore witness to thousands of soldiers who served in Viet Nam that blood was sacrificed for democracy and the American way. As the resident of 2509 Johns Way, I was the person who was traumatized to find a notice on the door that said I had to move out with little notice. The Wells Fargo Document was embarrassing and humiliating and unexpected since I knew the house was placed on the market to sell to avoid foreclosure. As a hardworking Black American, who raised two of my three siblings, including XXXXXXXX while working and attending the University of Georgia, yet another corporation has harmed me. The first corporation was my former employer CBS Television that discriminated against me and has resulted in my being unemployed since January 2007.

I am writing to ask you to use your authority to investigate Wells Fargo Bank for collusion and discrimination. Why would Wells Fargo in this economic environment go through foreclosure on a property to hand a listing over to a certain company, when the company had entered into an agreement to allow for the sell of the property and an accepted offer was in hand? Wells Fargo’s action in this case reeks of collusion. There was no written or verbal notice that foreclosure was imminent. How is the Wells Fargo handling the cases of minorities considering it was guilty of redlining? It’s time to see how foreclosures of Whites are handled vs. Foreclosures of the descendants of former slaves and other minorities. Has Wells Fargo ever foreclosed on another homeowner that had an accepted offer from the bank? Wells Fargo Bank benefited from the slave trade and it is still oppressing the descendants of former slaves.

I specifically say descendants of former slaves because business in this country has an established pattern of hiring minorities (Asians, Hispanics, Blacks Immigrated from Africa, Indians from Southeast Asia, etc) declaring they are diverse while shutting out qualified Blacks that are descendants of former slaves. As descendants of former slaves in the United States of America, our birthright, inheritance and legacy are still being denied.

If your office can’t assist, please forward it to the appropriate office that can take action to stop Wells Fargo from robbing our family. How many people are being pushed into poverty by the reckless callous actions of corporate executives who take no consideration for the people they are hurting while they wine, dine, and party with tax-payer dollars.

There is a moral obligation for you to stand up for the everyday American who has suffered for years while greed and power mongering has sold this country down the river.
Investigate Wells Fargo Bank. What has become of our country when people are standing at the Wells Fargo Bank asking for justice as on December 17, 2009 days before Christmas and not one network affiliate covered the actions of the everyday American working with the SEIU? As a three-time Associated Press Award winning journalist, I witnessed this lack of coverage with a heavy heart and in total amazement http://www.youtube.com/watch?v=WOlPCh6cqtE. I was surprised to find another protest by CCISCO Leaders that was also not covered: http://www.youtube.com/watch?v=gr3hD4hco7w by media. Freedom of the Press is essential to a fair and just democracy. Our country is suffering because media are sold out to the highest bidder. We, the everyday American, don’t have the money to pay for advertising that keeps media companies afloat at the expense of ignoring what’s really going on in the country. Wells Fargo can pay to keep news from the people through advertising which pays for television stations and news personnel.

What are you going to do to help people like XXXXXXXX and myself? This unjust action occurred to us. There are millions of Americans blaming themselves for what was orchestrated by corporate greed, who are not speaking out about the injustices perpetrated by fraudulent and greedy financial executives. Where are the true public servants that are making sure there is a balance of power that serves the individual as well as the corporation?

The attached Kinsman Redeemer document shows how some homes can be salvaged. We have been researching how to implement this idea that if utilized by the foundations of financial institutions many homes could be saved.

We are more than statistics. We are people and its time to recognize that our sufferings impact our city, our state and our nation. To ignore us is to ignore the nation and its potential for greatness. There is a moral imperative to do the right thing as indicated in James 5:1-5.

This is just one indication of individual responsibility no matter how big the corporation one tries to hide behind:

Now listen, you rich people, weep and wail because of the misery that is coming upon you. Your wealth has rotted, and moths have eaten your clothes. Your gold and silver are corroded. Their corrosion will testify against you and eat your flesh like fire. You have hoarded wealth in the last days. Look! The wages you failed to pay the workmen who mowed your fields are crying out against you. The cries of the harvesters have reached the ears of the Lord Almighty. You have lived on earth in luxury and self-indulgence. You have fattened yourselves in the day of slaughter. James 5:1-5.

I have written this not on behalf of XXXXXXXX, but myself as a citizen hurt by the actions of Wells Fargo Bank. XXXXXXXX may feel uncomfortable sharing the circumstances of our family because of the stoicism we have developed with the loss of our parents. I believe corporations and the bodies that oversee them should know how they are affecting people's lives. There actions are not personal, but they are having a very up close and personal effect on people that are too often hurtful. They act with "no malicious intent" but the results are malicious.

Kinsman Redeemer

“Saving Homes and Saving Lives”

Mission:

The mission of Kinsman Redeemer is to save homes and save lives through public-private partnership opportunities by assisting homeowners in financial need by pairing them with those in need of homes such as foster care youth, elderly, veterans and the re-entry population.

Kinsman Redeemer Foundation will be established to get homes out of foreclosure and keep the families in those homes by providing social services programs with emancipated youth, foster care youth, the elderly, veterans and the re-entry population. Homeowners will be carefully matched with the appropriate people through on-going case management.

Partners will include non-profits such as Lutheran Social Services of Northern California that we have begun to engage, churches, and businesses interested in increasing their social responsibility capital.

Political power of county and city governments will be engaged to help make a difference.

Bank Foundations will be asked to participate in the program as we begin with the inventory of their consumers that are in foreclosure.

Objective:

The goal is to match homeowners, especially those emerging out of the low income bracket who are in danger of being forced back into the poverty, with social service programs that can meet the need of paying part or all of their mortgage. A family may have a room or two rooms to rent to emancipated youth or they may rent their entire house out for a season of time for an entire program so that they can stabilize their home while they rent elsewhere.

Why Kinsman Redeemer?

The concept is based on the biblical principle in the Book of Ruth that shows how families should assist each other. Numerous studies have indicated that it is more economical to prevent an individual or family from spiraling down economically than trying to assist them once they fall through the cracks. Helping families helps prevent the children of the family from becoming another generation of the economically poor.
